1. Introduction and Acceptance

Welcome to YouClub. These Terms of Service ("Terms") govern your access to and use of the YouClub platform, including our website, mobile applications, and related services (collectively, the "Service").

By creating an account, purchasing vouchers, or using any part of our Service, you agree to these Terms. If you do not agree to these Terms, you may not use our Service.

YouClub is operated by YouClub GmbH. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. User Accounts and Eligibility

Eligibility:

  • You must be at least 18 years old to create an account and use our Service
  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account

Account Security:

  • We strongly recommend enabling two-factor authentication (2FA) for enhanced security
  • You must notify us immediately of any unauthorized access or security breaches
  • We are not liable for losses arising from unauthorized use of your account

Account Termination:

  • You may close your account at any time through your account settings
  • We reserve the right to suspend or terminate accounts that violate these Terms
  • Upon termination, you retain access to unused voucher balances for redemption

3. Voucher Purchase and Usage

Purchasing Vouchers:

  • Vouchers can be purchased through our platform using accepted payment methods
  • All purchases are subject to availability and partner acceptance
  • Voucher values are denominated in EUR (Euro) unless otherwise specified
  • Once purchased, vouchers are non-transferable between user accounts

Voucher Validity:

  • Vouchers are valid for redemption at participating partner locations
  • Vouchers do not expire unless required by applicable law or specified at time of purchase
  • Inactive vouchers may be subject to administrative fees after 24 months of inactivity

Redemption:

  • Vouchers can be redeemed in full or partial amounts at partner locations
  • Present your unique QR code to partner staff for validation and processing
  • Partial redemptions leave remaining balance available for future use
  • You are responsible for verifying the redemption amount before confirming

4. Payment and Fees

Payment Processing:

  • All payments are processed securely through our third-party payment providers
  • We accept major credit cards, debit cards, and other payment methods as displayed
  • Payment information is encrypted and handled in compliance with PCI-DSS standards

Pricing and Fees:

  • Voucher prices are displayed in EUR and include all applicable taxes
  • We do not charge additional fees to customers for voucher purchases
  • Partner businesses may be subject to transaction fees as outlined in partner agreements

Payment Issues:

  • Failed payments will prevent voucher issuance until payment is successfully processed
  • You are responsible for ensuring sufficient funds and valid payment methods
  • Contact our support team for assistance with payment-related issues

5. Refunds and Cancellations

Refund Policy:

  • Voucher purchases are generally final and non-refundable once issued
  • Refunds may be granted at our sole discretion in cases of technical errors or fraud
  • Unused voucher balances can be redeemed at participating partners indefinitely

Disputing Charges:

  • Contact our support team within 30 days of a transaction to dispute charges
  • Provide transaction details and explanation of the dispute
  • We will investigate and respond within 10 business days

Exceptions:

  • Refunds are provided if a partner permanently closes before voucher redemption
  • Technical issues preventing voucher redemption may qualify for refunds
  • Statutory consumer rights under applicable law always apply

6. Partner Responsibilities

For Partner Businesses:

  • Partners must honor valid vouchers presented by customers
  • Partners must accurately process redemptions using the provided QR scanner
  • Partners are responsible for maintaining accurate business information on the platform
  • Partners must comply with all applicable laws and regulations

Partner Obligations:

  • Provide goods or services equivalent to the voucher value redeemed
  • Process redemptions promptly and without discrimination
  • Notify YouClub of any business closures or significant operational changes
  • Maintain accurate redemption records and participate in dispute resolution

7. Prohibited Activities

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to other accounts or systems
  • Create fraudulent accounts or provide false information
  • Duplicate, sell, or transfer vouchers outside the platform
  • Interfere with the proper functioning of the Service
  • Use automated tools (bots, scripts) to access or manipulate the Service
  • Reverse engineer, decompile, or disassemble any part of the platform
  • Harass, abuse, or harm other users or partners
  • Violate any applicable laws, regulations, or third-party rights

Violations may result in immediate account suspension or termination, and we may pursue legal action where appropriate.

8. Intellectual Property

Platform Ownership:

  • All content, features, and functionality of the Service are owned by YouClub
  • This includes text, graphics, logos, images, software, and trademarks
  • You may not copy, modify, distribute, or create derivative works without permission

Limited License:

  • We grant you a limited, non-exclusive license to access and use the Service
  • This license is for personal, non-commercial use only
  • The license terminates upon violation of these Terms or account termination

Partner Content:

  • Partners retain ownership of their business information, logos, and descriptions
  • Partners grant YouClub a license to display their content on the platform
  • Partners are responsible for ensuring they have rights to uploaded content

9. Limitation of Liability

Service Availability:

  • We strive for 99.9% uptime but cannot guarantee uninterrupted service
  • The Service is provided "as is" without warranties of any kind
  • We are not liable for service interruptions, data loss, or technical issues

Partner Actions:

  • We are not responsible for the quality of goods or services provided by partners
  • Disputes regarding redemptions should be addressed with the partner directly
  • We facilitate connections but are not party to transactions between users and partners

Limitation of Damages:

  • Our total liability is limited to the amount you paid for vouchers in the past 12 months
  • We are not liable for indirect, incidental, or consequential damages
  • Some jurisdictions do not allow liability limitations, so these may not apply to you

10. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

Key privacy principles:

  • We collect only information necessary to provide the Service
  • We use industry-standard security measures to protect your data
  • We do not sell your personal information to third parties
  • You have rights to access, correct, and delete your personal data

11. Dispute Resolution

Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
